Party Wall Act — Key Considerations

When a project involves work to a shared boundary or party wall, the Party Wall etc. Act 1996 applies.

When Does It Apply?

  • Building on or at the boundary
  • Cutting into a party wall
  • Excavating near neighbouring buildings

Key Steps

  1. Serve notice at least 2 months before work
  2. Obtain agreement or appoint surveyors
  3. Prepare a schedule of condition
  4. Ensure award is in place before starting

Common Pitfalls

  • Starting work before notices served
  • Assuming verbal agreement is sufficient
